SafePassage Terms of Service

1. Introduction

SafePassage, S.A.S. ("SafePassage," "we," "us," or "our") offers AI-powered age and document verification services. By creating an account or using our services, you agree to these Terms of Service.

Eligibility: You must be at least 18 years old to create an account or use our services.

Account Responsibility: Account holders are responsible for maintaining credential confidentiality and updating their information accurately.

2. Services

Our platform provides:

  • Age Estimation: Using artificial intelligence to estimate user age
  • Document Verification: Validating identification documents
  • API Integration: Programmatic access to verification services

Service Availability: We aim for 99% uptime but do not guarantee uninterrupted service. Technical support varies by subscription tier, with enterprise plans offering additional options.

Privacy Infrastructure: We partner with Emblem for privacy infrastructure, ensuring data separation between verification services and content providers through "double anonymity" architecture.

3. Subscription Plans and Billing

Services operate on a tiered subscription model with:

  • Monthly base fees
  • Included verification quantities
  • Overage rates for additional usage

Payment Processing: Payments are processed through our payment provider with automatic recurring charges.

Plan Changes: You may upgrade immediately or downgrade at the next billing cycle. We reserve the right to modify pricing with 30 days' notice via email.

Failed Payments: Failed payments trigger retry attempts after 3 business days, potentially resulting in service suspension or downgrade.

4. User Responsibilities

You agree to:

  • Comply with all applicable laws
  • Not use services for unlawful purposes
  • Not infringe on intellectual property rights
  • Not circumvent security measures
  • Not create multiple free accounts

API Users: Must respect rate limits and maintain valid API keys.

Integration: Implementers bear responsibility for proper deployment and user communication.

5. Data and Privacy

SafePassage implements a privacy-first approach:

  • We minimize data retention
  • Facial images and identification documents are never stored beyond verification necessity
  • Encryption protects data in transit and at rest
  • Data breach notification occurs within 72 hours of discovery

Third-Party Processors: Emblem acts as a subprocessor with appropriate safeguards.

User Rights: You have rights to human intervention and decision contestation regarding automated age determinations.

6. GDPR Compliance

For EEA users:

  • SafePassage functions as an independent data controller
  • Businesses using the service act as separate controllers for their own collected data
  • We confirm GDPR and applicable data protection regulation compliance

7. Intellectual Property

SafePassage retains all rights to its services, software, algorithms, and interfaces.

License Grant: You receive a limited, non-exclusive, non-transferable license for internal business purposes only.

Prohibited Activities:

  • Reverse engineering
  • Modification
  • Sublicensing
  • Competitive use

8. Disclaimers and Limitations

Services Provided "As Is": Services are provided without warranties.

AI Limitations: Age estimation relies on AI algorithms providing estimates rather than definitive determinations. There are inherent limitations to this technology.

Liability Cap: Our liability is capped at the greater of $100 or amounts paid in the preceding twelve months.

9. Indemnification, Term, and Termination

Indemnification: You agree to indemnify SafePassage and Emblem against claims arising from:

  • Service use
  • Terms violations
  • Third-party rights infringement

Termination: SafePassage may terminate accounts immediately for:

  • Breach of these terms
  • Non-payment
  • Abuse
  • Legal liability concerns

Post-Termination: Data export is available for 30 days before deletion.

10. General Provisions

Governing Law: Washington State law governs these terms, with exclusive jurisdiction in King County courts.

EU Consumer Rights: EU consumers retain mandatory consumer protection rights and may pursue home country proceedings.

Dispute Resolution: Disputes resolve through JAMS arbitration, excluding jury trials.

Modifications: We reserve the right to modify these terms with 30 days' notice.

Third-Party Beneficiaries: Emblem is an express third-party beneficiary of these terms.
